Waina enables users to instantly create AI-native websites that adapt to visitors’ needs and interactions. Instead of building code manually, Waina uses your provided content, existing website data, or connected CMS to generate a fully functional, intelligent website in seconds.

  • Dynamic AI Assistant: Each website includes an AI-powered interface that intelligently answers questions, guides visitors, and personalizes the experience.

  • Analytics and Optimization: Understand visitor behavior and engagement with AI-driven insights.
  • Customization and Controls: Adjust design, content, and tone through the platform dashboard or CMS integrations.

3. Account Registration and Security

To use certain parts of the Service, you may need to create an account. You agree to provide accurate, current information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at contact@waina.ai if you suspect unauthorized use.

4. Content and Data Use

When you provide content—through uploads, CMS connections, or website imports—you grant Waina permission to process, store, and display that content solely to operate and improve the Service.

  • Ownership: You retain all rights to your content. Waina does not claim ownership over it.
  • License to Operate: You grant Waina a limited, non-exclusive, and royalty-free license to host, process, and use your content to deliver and enhance the Service.
  • Integrations: When connecting external systems (e.g., CMS, storage, or analytics tools), Waina may use OAuth or API access to retrieve and update content as authorized.

5. Acceptable Use Policy

You agree not to misuse the Service. Specifically, you will not:

  • Use Waina for unlawful or fraudulent purposes.
  • Upload, publish, or generate content that infringes on intellectual property, privacy, or other legal rights.
  • Attempt to access unauthorized parts of the Service or other users’ accounts.
  • Use the platform to create or distribute harmful, misleading, or discriminatory content.
  • Interfere with or disrupt Waina’s infrastructure or attempt to bypass security or usage limitations.

6. Privacy and Data Security

Your privacy is important to us. By using Waina, you agree to our Privacy Policy, which explains how we handle your data.

  • Storage and Processing: Your data is securely stored and processed only to operate and improve the Service.

7. Intellectual Property

You retain full ownership of the websites and content you create using the Service.

8. AI-Generated Content and Disclaimers

  • AI Limitations: Content generated by AI may contain inaccuracies or unintended outputs. You are responsible for reviewing and approving all AI-generated material before publishing.
  • No Guarantees: We do not guarantee that AI content will meet specific business, marketing, or legal standards.
  • Responsibility: You are responsible for how your website uses or presents AI-generated information.

9. Payments and Subscriptions

Some Waina features require a paid subscription. By subscribing, you agree to the pricing, billing, and renewal terms posted on our website. Fees are non-refundable unless otherwise required by law. You are responsible for any applicable taxes.

10. Termination

You may delete your account at any time. We may suspend or terminate access if you violate these Terms, abuse the Service, or engage in activities that harm others or our systems.

11. Disclaimers

The Service is provided “as is” and “as available.” Waina disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted operation or error-free results.

12. Limitation of Liability

To the maximum extent permitted by law, Waina and its affiliates are not liable for indirect, incidental, or consequential damages, including lost profits or data. Our total liability shall not exceed the amount you paid Waina in the past twelve (12) months (or $0 if you have not paid).

13. Indemnification

You agree to indemnify and hold harmless Waina, its affiliates, and its employees from any claims, damages, or losses arising from your use of the Service or your violation of these Terms.

14. Modifications

We may update these Terms at any time. Material updates will be announced by posting the new Terms and updating the “Last Updated” date above. Continued use of the Service after updates constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of Catalonia, Spain. Any disputes shall be resolved exclusively in the courts of that jurisdiction.
